RAYFLEX places the utmost importance on the security of personal data. Rayflex takes the highest possible level of security measures within the framework of applicable legislation to ensure the lawful collection, storage, and sharing of your personal data and to protect your privacy. Aware of this responsibility, we process your personal data as the data controller in accordance with Law No. 6698, as explained below and within the legal framework.
Your personal data is collected electronically via the Rayflex website by Rayflex in order to carry out our web communication, inquiry, or complaint handling activities, and based on legal grounds such as compliance with legislation and Rayflex policies, fulfillment of contracts, legal obligations, and Rayflex’s legitimate interests. Your personal data may also be processed for the purposes stated in this Clarification Text, in accordance with the principles outlined by the Personal Data Protection Law (KVKK), and under the conditions and purposes for processing personal data as set out in Articles 5 and 6 of KVKK.
Unless legally required, the personal data processed here is not shared with third parties beyond the purposes listed below.
1) Identity of the Data Controller and Its Representative
In accordance with Article 10 of the Personal Data Protection Law No. 6698 (“
KVKK“), the scope of processing your personal data by
RAYFLEX as the data controller is explained below.
2) Purpose of Processing Personal Data
Your collected personal data may be processed by Rayflex for the purposes listed below in accordance with the fundamental principles prescribed by legislation:
- To fulfill our legal obligations regarding data retention, reporting, and notification as required by official authorities;
- To review, evaluate, and respond to requests from official authorities or relevant individuals;
- To manage information security processes;
- To carry out communication activities;
- To ensure the security of data controller operations;
- To follow up on inquiries or complaints;
- To fulfill the burden of proof in any future legal disputes;
- To process data under the conditions and purposes stated in Articles 5 and 6 of the KVKK.
3) Rights of the Personal Data Owner Under Article 11 of Law No. 6698
As personal data owners, if you submit your requests regarding your rights to Rayflex using the methods set forth in the Rayflex Personal Data Protection and Processing Policy published on www.rayflex.com.tr, Rayflex will conclude your request as soon as possible and no later than thirty days, depending on the nature of the request. However, if the transaction requires an additional cost, the fee set by the Personal Data Protection Board may be charged. In this context, personal data owners have the right to:
- Learn whether their personal data is being processed,
- Request information if their personal data has been processed,
- Learn the purpose of the processing and whether it is used appropriately,
- Know the third parties to whom the data is transferred, domestically or abroad,
- Request the correction of personal data if it is incomplete or incorrect and to request notification of such corrections to third parties to whom the data has been disclosed,
- Request the deletion or destruction of personal data if the reasons for processing no longer exist, even if it was processed in accordance with the law, and request notification of such deletion to third parties to whom the data has been disclosed,
- Object to the occurrence of a result against themselves due to analysis of processed data exclusively through automated systems,
- Request compensation for damages incurred due to unlawful processing of personal data.
In cases where a request is denied, the response is found inadequate, or no response is received within the time limit, the relevant person may file a complaint with the Personal Data Protection Board within thirty days of learning the response and no later than sixty days from the date of the request. According to Article 13 of the Law, the complaint process cannot proceed unless the application procedure has been exhausted.
